1. Introduction and Acceptance of Terms
Welcome to Éire Arís ("the Platform"), a digital platform operated by the Nationalist Council of Eire ("the Council," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of the website located at [www.eirearis.org] (or its designated URL) and all associated services, content, and functionality, including the non-governmental voting initiative culminating on 21 September 2025.
By accessing, browsing, or using the Platform, including by registering an account or casting a "Vote" (as defined below), you ("the User," "you," "your") acknowledge that you have read, understood, and agree to be legally bound by these Terms and our Privacy Policy, which is incorporated herein by reference.
If you do not agree to these Terms, you must immediately cease all use of the Platform.
2. Definitions
"Platform": Refers to the Éire Arís website, its subdomains, and all associated software, databases, and services.
"Vote": Refers to the symbolic, non-binding expression of support cast by a User through the Platform's digital ballot system. This term is used for illustrative purposes only and does not denote a vote in a state-sanctioned, official, or legally recognised election or referendum.
"Personal Data": Refers to any information relating to an identified or identifiable natural person, as defined under the General Data Protection Regulation (GDPR) (EU) 2016/679.
3. Eligibility and User Declarations
Access to and participation in the core functions of this Platform, specifically the casting of a Vote, is strictly limited. By checking the agreement box during the registration process, you hereby represent, warrant, and covenant the following as legally binding declarations:
- 3.1. Citizenship: You are a citizen of the Republic of Ireland and/or Northern Ireland.
- 3.2. Age: You are sixteen (16) years of age or older.
- 3.3. Voter Eligibility: The candidate(s) for whom you are casting a Vote are, to the best of your knowledge, citizens of the Republic of Ireland and/or Northern Ireland.
- 3.4. Consent to Contact: You expressly consent to be contacted by the Council or its designated agents via the email address and/or phone number you provide for the sole purpose of verifying your identity and the authenticity of your Vote.
Providing false, inaccurate, or misleading information in these declarations constitutes a material breach of these Terms. The Council reserves the right to nullify your Vote and terminate your access to the Platform without notice if it has reasonable grounds to suspect a breach of these declarations.
4. CRITICAL DISCLAIMER: Nature of the "Vote"
It is essential that all Users understand the nature of this initiative. You explicitly acknowledge and agree to the following:
- 4.1. Non-Governmental Initiative: The Éire Arís voting process is an independent, private initiative organised by the Nationalist Council of Eire. It is NOT a state-sanctioned, official, or constitutional election or referendum.
- 4.2. No Legal Effect: The "Vote" you cast on this Platform has NO LEGAL STANDING OR EFFECT whatsoever. The results of this vote are not legally binding on any governmental body, public official, or entity.
- 4.3. Symbolic Purpose: The purpose of this vote is to serve as a symbolic expression of support, to measure public sentiment within our community, and to mobilise support for the Council's mission and ideals. The results are intended for internal analysis and public demonstration of grassroots support only.
- 4.4. Independence from Electoral Commission: This Platform and its activities are not affiliated with, endorsed by, or acting on behalf of An Coimisiún Toghcháin (The Electoral Commission of Ireland) or any other official electoral body.
5. User Registration and Data Protection (GDPR Compliance)
5.1. Data Collection: To participate, you must provide certain Personal Data, including your full name, email address, and mobile phone number.
5.2. Lawful Basis and Purpose: We collect and process your Personal Data based on your explicit consent, provided during registration. The purposes for processing this data are strictly limited to:
- a) Administering the voting process.
- b) Verifying your identity and the uniqueness of your Vote to ensure the integrity of our vote.
- c) Communicating with you regarding your Vote and other essential Platform updates.
- d) Aggregating anonymised statistical data for national and county-level reports.
- e) Contacting you with information about the Council's mission, events, and calls to action, should you opt-in for such communications.
5.3. Data Security: We will implement reasonable and appropriate technical and organisational measures to protect your Personal Data against unauthorised or unlawful processing and against accidental loss, destruction, or damage.
5.4. Data Retention: Your Personal Data will be retained only for as long as is necessary to fulfil the purposes outlined above, or as required by applicable law. Following the conclusion of the initiative and associated analysis, personal identifiers will be anonymised or the data will be securely deleted.
5.5. Your Rights: In accordance with GDPR, you have the right to access, rectify, erase, restrict processing of, and port your Personal Data. To exercise these rights, please contact us at contact@eirearis.org.
5.6. No Sale of Data: We covenant that we will not sell, rent, or lease your Personal Data to any third party.
6. User Conduct and Acceptable Use
You agree not to use the Platform to:
- a) Submit any false, defamatory, or libellous information.
- b) Harass, abuse, or threaten others or otherwise violate any person's legal rights.
- c) Engage in any activity that is unlawful, fraudulent, or malicious.
- d) Attempt to cast more than one Vote per person or otherwise compromise the integrity of the voting system.
- e) Use automated systems (bots, spiders, etc.) to access the Platform or cast Votes.
- f) Distribute viruses, malware, or any other technologically harmful code.
A breach of these conduct rules will result in immediate termination of your access and nullification of your Vote.
7. Intellectual Property
All content on this Platform, including text, graphics, logos, software, and the compilation thereof, is the property of the Nationalist Council of Eire or its licensors and is protected by Irish and international copyright laws. The aggregated and anonymised data generated from the voting process shall be the exclusive property of the Council.
8. Disclaimers and Limitation of Liability
8.1. "As Is" Basis: The Platform is provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
8.2. No Guarantee of Accuracy: While we strive for accuracy, we do not warrant that the information on the Platform is complete, reliable, or current. Information regarding events, locations, or other details is subject to change without notice.
8.3. No Liability for Damages: To the fullest extent permitted by law, the Nationalist Council of Eire, its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Platform; (b) any conduct or content of any third party on the Platform; or (c) unauthorised access, use, or alteration of your transmissions or content.
9. Indemnification
You agree to defend, indemnify, and hold harmless the Nationalist Council of Eire and its affiliates, officers, directors, agents, and employees from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not inot limited to solicitors' fees) arising from: (i) your use of and access to the Platform; (ii) your violation of any term of these Terms; or (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right.
10. Governing Law and Jurisdiction
These Terms shall be governed and construed in accordance with the laws of the Republic of Ireland, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts of the Republic of Ireland to resolve any legal matter arising from these Terms.
11. Modification of Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Platform after any revisions become effective, you agree to be bound by the revised terms.
12. Severability
If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
